TSSAA records subject to open records laws

Last month, the Tennessee Court of Appeals upheld a lower court’s decision ruling that the TSSAA, while a non-profit corporation, it is the functional equivalent of a state agency and therefore subject to the state’s open records laws.

The action is a result of a lawsuit filed by the Nashville City Paper, now out of business, while conducting an investigation into illegal recruiting practices at Nashville’s Montgomery Bell Academy. The paper requested the records for the case.

The private/public athletic topic has been a hot one the past few years in Tennessee. A lot of the state’s public school systems have had questions in recent years about the issue, many of whom feel the private institutions stay “on top” by recruiting.
